Nod Terms of Use

This Nod Terms of Use (the “Terms of Use”) supplements the Master Enterprise Terms or Self-Serve Terms, as applicable (the “MET”) and the n8n AI Terms (the “AI Terms”) between n8n and Customer. Capitalized terms not defined here have the meanings given in the MET or AI Terms. In the event of a conflict, these Terms of Use control solely with respect to Customer’s use of Nod.

  1. Nod and the Connection Services

“Nod” is an AI-enabled application that Customer may install and operate on Customer-controlled devices or servers, regardless of deployment type. Nod may access and interact with third-party applications, websites and services connected or selected by Customer or its Authorized Users (“Third-Party Services”) and may use AI model providers selected by Customer. Certain Nod functionality may use services operated by or on behalf of n8n, including the Cloud Services or Software, including a connection service through which, by default, requests to and results from connected Third-Party Services pass.

“Connection Service” means a service operated by or on behalf of n8n that enables Nod to establish and manage authenticated connections with Third-Party Services and to transmit requests to, and receive results from, those Third-Party Services. The Connection Service does not include functionality processed solely within Customer’s environment or services separately selected or configured by Customer. The Connection Service does not refer to the n8n Cloud Services or Software, which is independently licensed under the MET.

  2. Customer Accounts and Authority

Customer is solely responsible for ensuring that its Authorized Users are authorized to connect any account, application, data source, credential or payment method to Nod and to instruct Nod to access or act through such Third-Party Services.

Nod may, at the direction of an Authorized User, create, modify, transmit or delete information or take other actions through the Third-Party Services. Nod uses an AI model to decide which actions require Customer approval, and that decision may not always be correct. Customer is solely responsible for instructions provided to Nod. n8n does not become a party to, or assume responsibility for, any transaction or agreement entered into through Nod or a Third-Party Service.

  3. Customer Content and n8n Connection Services

Where the Connection Service is used, requests to and results from connected Third-Party Services are processed through the Connection Service. Customer Content otherwise processed locally by Nod remains within the Customer-controlled environment unless transmitted to a Third-Party Service, AI provider or other recipient as directed or enabled by Customer. Where Customer uses the n8n Cloud Services, relevant requests, instructions and results may be processed by n8n and its applicable subprocessors in order to provide the requested connection.

To the extent n8n processes Personal Data on Customer’s behalf through the Connection Services, the data processing agreement (“DPA”), available at https://n8n.io/legal/data-processing-agreement/, applies, unless Customer has already agreed to a DPA with n8n.

Selected AI providers or Third-Party Services, and any other services contracted or selected directly by Customer are not n8n subprocessors solely because Nod interoperates with them. Customer is solely responsible for its relationship with and use of such services.

  4. Credentials

Nod, via permissions granted by an Authorized User, may use credentials, authentication tokens, browser sessions or other authentication mechanisms provided or authorized by Customer to access these Third-Party Services. n8n will not use such credentials except as necessary to provide the functionality requested by the Customer and its Authorized Users.

Customer acknowledges that permitting Nod to use a credential may allow Nod to exercise the permissions associated with that credential even where the underlying secret is not disclosed to an AI model, and n8n disclaims all responsibility for Nod’s use of such credentials.

  5. Optional Data Sharing

Customer is able to opt-in to sharing usage data, which is composed of certain diagnostic or analytic data that may transmit information from Nod to n8n. This only occurs when enabled by an Authorized User. In these Terms of Use, “usage data” refers to the Events and Recordings of Customer’s interactions with Nod. An “Event” means information about how an Authorized User or Nod interacts with the application, including actions taken in the app, setup activity, task initiation or completion, device and configuration information, domains of websites visited, accessed or used for payments, payment amounts and currencies, and use of an AI model. A “Recording” means a recording of an Authorized User’s interaction with the Nod app, including the app layout, clicks and scrolling. Text, chats and files are automatically masked in Recordings. For clarity, usage data does not include technical communications reasonably necessary to provide, secure or update Nod.

If Customer separately consents to the sharing of conversation traces with n8n, such traces may include de-identified or pseudonymised conversation elements, such as prompts, responses, tool inputs or outputs. Nod automatically removes known secrets and recognised personal identifiers, such as email addresses, phone numbers and payment card numbers. n8n recommends that no personal information be submitted in plain text. This information is collected for operating, diagnosing, securing and improving Nod, and n8n will not use these traces to train generative AI models. They will be retained for no longer than fourteen (14) days unless a longer period is required by law or agreed to with the Customer.

Where n8n determines the purposes and means of processing analytics, diagnostic or update information, voluntarily submitted feedback, usage data or traces enabled by Customer, n8n processes such data as an independent controller in accordance with its Privacy Policy available at https://n8n.io/legal/privacy/.

  6. Third-Party Services

Nod depends on or interoperates with services that are not controlled by n8n. Customer’s use of such services is subject to the applicable third-party terms, and n8n is not responsible for the availability, acts or omissions of Third-Party Services except to the extent expressly provided in the MET.

  7. Open Source Software

Nod contains Apache License 2.0 licensed components, and Customer’s rights in the applicable open-source software are governed by that licence. Third-party software included with or used by Nod remains subject to its applicable licence terms. Except to the extent expressly permitted under such licence, Customer shall not use n8n’s proprietary software, services, documentation, confidential information or other intellectual property to develop, market or provide a product or service that competes with n8n, or otherwise infringe, misappropriate or violate n8n’s or any third party’s intellectual property rights. For clarity, the exercise of rights granted under the Apache License 2.0 does not by itself breach this Section.

  8. AI Terms

The AI Terms, available at https://n8n.io/legal/ai-terms/, continue to apply to AI functionality provided through Nod. For clarity, Customer Content may be transmitted to a Customer-selected AI provider where necessary to perform Customer’s instruction. The separate processing described in Section 5 of these Terms of Use is governed by these Terms of Use and is not deemed model training under the AI Terms. For the avoidance of doubt, conversation traces are not used for AI Training, but synthetic data derived from usage data may be.

  9. Disclaimer; No Warranties; Limitation of Liability

Nod is provided “AS-IS” and “As Available.” To the maximum extent permitted by applicable law, n8n gives no representations, warranties, conditions or other terms, whether express, implied, statutory or otherwise, in relation to Nod, including as to availability, accuracy, reliability, fitness for a particular purpose, satisfactory quality, non-infringement, security, compatibility or that Nod will operate without interruption or error or produce any particular result.

Customer acknowledges that Nod may generate inaccurate or incomplete outputs and may take actions through Connection Services at Customer’s direction. Customer is solely responsible for reviewing Nod’s outputs and actions and for determining their suitability before relying on them.

To the maximum extent permitted by applicable law, n8n’s aggregate Liability arising out of or in connection with Nod shall not exceed £1,000. In no event shall n8n have Liability arising from: (a) any output, recommendation or action generated or taken by Nod; (b) any Third-Party Service or AI provider; or (c) any loss, corruption, disclosure or alteration of data arising from Customer’s use of Nod. Nothing in this Section excludes or limits Liability that cannot lawfully be excluded or limited, including Liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

  10. Governing Law and Jurisdiction

These Terms of Use, and any dispute or claim arising out of or in connection with it or Nod, including any non-contractual dispute or claim, shall be governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms of Use or Nod, including any non-contractual dispute or claim.
